1. Acceptance of Terms
By accessing or using our website, registering for a webinar, booking a connection call, or signing up for a retreat, you agree to be bound by these Terms and our Privacy Policy.
2. Eligibility
You must be at least 18 to use the website and at least 21 to register for any retreat. By registering, you represent that you meet the age requirement and have the legal capacity to enter into these Terms.
3. Accounts & Registration
When you register, you agree to provide accurate, current, and complete information. You are responsible for keeping your information up to date and for all activity under your registration. Notify us immediately of any unauthorized use.
4. Retreat Participation
Retreat participation is subject to a separate Participant Agreement that includes informed consent, medical screening, contraindication disclosures, conduct expectations, and an assumption-of-risk acknowledgment. The Participant Agreement is provided after acceptance into a cohort and must be signed before arrival.
Ceremonia reserves the right to deny or cancel participation if, in our sole judgment, participation would create a safety risk to you or others, or if you misrepresent material information during intake.
5. Medical Disclaimer
Ceremonia’s programs are not medical or psychiatric treatment. We do not diagnose, treat, cure, or prevent any disease. Information on this website is educational and is not medical advice. Always consult qualified healthcare providers about decisions affecting your health, especially before participating in any program involving plant medicine.
Plant medicines have contraindications. We screen carefully but you remain responsible for disclosing all medications, conditions, and medical history accurately. Failure to disclose can be dangerous.
6. Legal Frameworks (RFRA & NMHA)
Ceremonia operates under two distinct legal frameworks:
- Religious Freedom Restoration Act (RFRA, 1993), provides federal protections for sincere religious exercise involving sacramental plant medicines. Ceremonia holds ayahuasca ceremonies as sacramental religious practice within a 508(c)(1)(a) faith-based framework. See RFRA.
- Colorado Natural Medicine Health Act (NMHA, Proposition 122), established a state-licensed framework for supervised psilocybin services in Colorado. Ceremonia operates as a licensed healing center under this Act. See NMHA.
These frameworks have requirements and limits. Nothing on this website should be construed as legal advice for your own circumstances. Consult an attorney if you have specific legal questions.
7. Payment, Refunds & Cancellation
Retreat fees, deposits, and payment schedules are described at the time of registration. Cancellation and refund terms are set out in the Participant Agreement provided at the time of booking and may include non-refundable deposits, transfer windows, and rescheduling options.
All payments are processed by third-party payment processors. Disputes about charges should first be raised with us at billing@ceremoniacircle.org.
8. User Conduct
You agree not to:
- Use the services for any unlawful purpose
- Misrepresent your identity or eligibility
- Attempt to disrupt or compromise the website or its security
- Scrape, mirror, or harvest content without written permission
- Harass, threaten, or harm other participants, staff, or facilitators
- Resell, sublicense, or commercialize access to our programs
9. Intellectual Property
All content on this website, text, design, graphics, logos, audio, video, software, is the property of Ceremonia or its licensors and is protected by copyright, trademark, and other laws. You may view content for personal, non-commercial use only. Any other use requires our prior written consent.
10. User-Generated Content
When you submit testimonials, integration responses, photos, comments, or other content (“User Content”), you grant Ceremonia a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, distribute, display, and modify that content for our programs, marketing, and educational materials. You retain ownership of your User Content.
You represent that your User Content does not violate any third-party rights and that you have permission to grant this license.
11. Third-Party Links & Services
Our website may link to third-party sites and services. We do not control them and are not responsible for their content, policies, or practices. Linking does not constitute endorsement.
12. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, CEREMONIA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We make no warranty that the website will be uninterrupted, error-free, secure, or free of viruses, and we make no representation as to the results that may be obtained from use of the services.
Outcomes from retreat participation vary by individual. We make no claim that any participant will achieve a particular result. Plant-medicine work is not a guaranteed therapy or cure.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CEREMONIA AND ITS OFFICERS, EMPLOYEES, FACILITATORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.
Our aggregate liability for any claim arising out of these Terms or the website shall not exceed the greater of (a) the amount you paid to Ceremonia in the 12 months preceding the claim or (b) USD $100. Liability arising out of retreat participation is governed separately by the Participant Agreement.
14. Indemnification
You agree to defend, indemnify, and hold harmless Ceremonia and its officers, employees, facilitators, and agents from any claim, damage, or expense (including reasonable attorneys’ fees) arising out of your use of the services, your User Content, or your violation of these Terms.
15. Dispute Resolution & Arbitration
Any dispute arising out of these Terms or your use of the services shall first be addressed by good-faith negotiation. If unresolved within 60 days, the dispute shall be submitted to binding arbitration administered by JAMS in Denver, Colorado, under its Comprehensive Arbitration Rules then in effect. Judgment on the award may be entered in any court of competent jurisdiction.
You waive any right to a jury trial and to participate in a class action. Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights.
16. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws provisions, and applicable U.S. federal law. Venue for any non-arbitrable matter shall be in Denver County, Colorado.
17. Changes to These Terms
We may update these Terms. The “Last updated” date at the top will reflect changes. Material changes will be communicated via email to active participants and prominent notice on the site for at least 30 days. Continued use after the effective date of changes constitutes acceptance.
